Highland Homes of Davenport Florida took advantage of a Senior Citizen and two Disabled People? My Mother Minnie L.

Hayes past away March 15, 2016. Born June 23, 1918, she was 96 and well when the following events started happened. My Mother, brother, an other disabled brother and disabled son lived together for over twenty years. Even though I didn't live with them, all five us work together to give this disabled part of my family a happy and comfortable life.

About 11 years ago Mom had a stroke after getting lost and frightened in the California fires. She was afraid to go out side, go to the store or drive her car. I was soon to retire, so I planned to move all of us to Florida. This plan worked great til the market crashed and I was unable to by them a home but that did not stop us.

We rented a home on Declaration Drive, in Kissimmee. At first it was great but the landlord would not fix and/or repair broke old appliances, replace carpet, fix windows and ....ect. My brother kept it clean but it was run downed. There was enough money between all of us to purchase a new home.

So I went looking. On April 20, 2017, I found Highland Homes in Haines City and signed contract to purchase their Shenandoah 11 home in Highland Meadows Phase 2A for $206,594.00. They advertised they would deliver the American Dream by creating a satisfying home buying experience but all we got was a nightmare. I believed in Ken Losch and Rebekah Green the sales people could help us achieve this.

After talking to there corporate office, credit and background checks they insured me everything would be ok and my family will have a fine home. I explained my family situation and they continued to insured me everything would be ok. But I need a $7061.00 deposit to start applications. Which was no problem because I saved money for about 12 years for this day.

They even agreed to pay 6% of the closing cost. I gave them this money in good faith that my family would be living in a new spacious home. I followed there financing instructions. Whatever information they wanted I got it.

There was nothing undone. Our file was submitted to Cameron Beckham at Quicken Loans on April 15, 2015 for HUD financing. Our application was accepted for financing and verifying and information requests had to be answered. The applications and information requests were completed.

Then all of sudden they required more information and addendum after addendum. It became very confusing with the on-line requests and the many e-mails but I believe they were surprised I could keep up with their requests..i.e. financial record, medical records, VA Records and anything else they wanted . Even though there was no more information or verifications needed we still and did not close.

We just waited and waited for an answer form Quicken Loans. It was coming to the end of October and our lease on the rental property had ended and we had to move. by November 5, 2015 from Declaration Drive. Not sure what to do, I went to Rebbecca a Highland Homes and explained my situation.

She requested a rental agreement for early move in of the property we were buying, Since it was move in ready and we would be closing in a few weeks. The agreement was to pay $900.00 a month til closing. We did for 6 months for a total of $5400.00 But there was no closing. December 18, 2015, 7 months after we applied and just before they promised Highland Homes and my family we were ready to close, they claimed they could not do the loan.

I was told to keep the faith the Quicken Loans has done this before but we still had a solid file for financing and they had a financial company that would do the loan.. Home Solution Lenders was wonderful! They were kind and very understanding of what was happening to my family because of Quicken Loans. After a little more paperwork for their company we were scheduled to close March 16, 2015 the day after my Mother past away.

I knew buying a new home was no more. So I requested our deposit back so I could bury my Mother and find new residents for the rest of the family. They refused to return the deposit. Told us we had to be out in 30 days.

I had very little money after all this so had to borrow money from family members and friends. I pleaded with Highland Homes several times to return my deposit. I even went to their cooperate office to state my situation but they became rule and threatened me with there lawyers through Rebecca Green our sales person. They said I failed to obtain a loan.

with in 45 days of purchase? I told her that was not right we did everything your company wanted us to do. I went to a couple of lawyers but they wouldn't take the case. They both said it wasn't worth it to them.

We left the home clean but I think because my Mother died in the home, they would have a hard time selling it. Maybe this is why they would not return the deposit? I don't know. I was not ever given and explanation why thy wouldn't return the deposit.

Just that if I keep bothering them I will hear from their lawyers. How could they treat a Senior Citizen and the Disabled this way? They took $5400.00 for rent and $7061.00 for deposit. I lost $12,461.00.

I only request the deposit back. I even though I fell I should get most of the money back I only ask for 1/2 and they still refused. I kept my paperwork and can verify everything I have said above.
